On October 19, 2015, the Judges Division of the NLRB updated its 2010 ALJ Bench Book by issuing a new 2015 edition. The Bench Book serves as a procedural and evidentiary reference for ALJs and litigants during and in preparation for NLRB trials. As such, the Bench Book, and the precedent and authorities within, are often cited to throughout the course of litigation at an NLRB trial.
The 2015 edition of the Bench Book includes updated citations and summaries of NLRB and court decisions through September 2015, and also provides for an evidence chapter which incorporates the applicable Federal Rules of Evidence with the same numbering system. Moreover, the former Chapter 11 on Miscellaneous Procedural Matters has been deleted, with the content now distributed throughout other chapters. The 2015 edition also includes new chapters on Motions and Special Appeals (Chapter 10), The Hearing Record (Chapter 12), Board Precedent and Relitigation of Issues (Chapter 13), and Supplemental or Related Proceedings (Chapter 14).
