And, as a note of caution, employers offering such benefits may need to consider recent legislation (including the CAA, SECURE 2.0, State law mandates) and case law developments (including the Dobbs decision) to see how things might be changing, including:

  • Automatic enrollment in 401(k) plans
  • Student Loan Assistance Programs
  • Emergency Savings Programs
  • 529 College Savings Programs
  • Telehealth
  • Fertility and/or medical travel benefits, including through a health reimbursement arrangement (HRA)
  • Adoption Assistance Programs

As employers design, draft, implement, and administer their programs, make sure to reach out to ERISA counsel to review the latest cases, legislative and regulatory terrain, and operational pitfalls.
