On November 7, 2025, the U.S. Court of Appeals for the Sixth Circuit ruled that, in some cases, night blindness may be considered a disability under the Americans with Disabilities Act (ADA). In Edwards v. Shelby County, Tennessee, the court upheld a jury verdict finding that the employer discriminated against an employee because of her night blindness and retaliated against her after she requested an accommodation. The court also upheld a separate finding that the employer failed to accommodate her asthma.
