On July 21, the U.S. Equal Employment Opportunity Commission (EEOC) voted to issue a Notice of Proposed Rulemaking that would rescind the requirement for most private employers with 100 or more employees to file annual reports with information about the race and sex of their employee populations. Members of the public will have 30 days from publication of the Notice in the Federal Register to submit comments. A public hearing on the proposal will be held on August 11, 2026.
Note to Employers: this is only a proposed rule. Until a final rule is issued (and upheld in the event of any court challenges), the existing regulations, and employer obligations, remain in effect. Additionally, some states, such as California, Illinois and Massachusetts, require certain employers to provide demographic information. Accordingly, even if this rule passes, employers should be mindful of any applicable state and local requirements.
