作者：刘新宇 戴梦皓 美国出口管制可以从广义和狭义两个层面来理解。广义上而言，是指美国政府对特定敏感商品、软件和技术的出口、再出口和（国内）转移行为，施加特定限制措施的管理行为，其体系主要由监管两用物项的美国《出口管理条例》（EAR）、监管国防物品和国防服务的《国际武器贸易条例》（ITAR）、美国其他行政部门管理并执行的出口管制法规构成。就狭义层面而言，美国出口管制是指以 EAR 为核心、以两用物项管制为目的而形成的法律法规体系。2018 年 8 月 13 日，美国总统特朗普签署通过了《2018 年出口管制改革法案》（Export Control Reform Act of 2018，下称 ECRA），该法案的通过为 EAR 提供了永久性的上位法律依据。 阅读更多
