作者：李馨 张雪纯 根据我国《劳动合同法》第48条，在用人单位违法解除或者终止劳动合同时，劳动者享有请求继续履行劳动合同或请求支付违法解除劳动合同的赔偿金两种救济渠道任选其一的权利。然劳动关系毕竟具有人身属性，若用人单位认为其已丧失对劳动者的基本信任，无法再恢复与劳动者的劳动关系以安排其继续在具体的团队中工作，但劳动者认为其非常乐意返回到原来的工作岗位继续履行职责时，如法院判决恢复劳动关系的，从企业用人管理的实操层面可能给企业带来一定程度的难言之隐，也无法真正调和劳资双方矛盾；此外，恢复劳动关系后带来的历史工资待遇补发及其标准、用人单位仍然拒不恢复劳动者具体工作岗位的强制执行等问题在目前的司法实践中存在讨论空间和实际困难。但若不予支持恢复劳动关系，则导致劳动者的法定权利在司法实践中受到限制，从而可能产生“用人单位只要愿意出钱就可以解除员工”的现实局面。因此在这个问题上如何既维护劳动者合法权益又保障用人单位的经营自主权尤待权衡。从法律实务角度，用人单位在做出对员工的解除决定之前，更要对所在地的司法实践进行谨慎的研究，以客观评估单方解除劳动关系后的法律风险。本文将以北京、上海、广州、江苏四地裁审口径为基础进一步探讨“恢复劳动关系”的问题。 阅读更多
