《国务院关于对外投资的规定》自2026年7月1日起施行。该《对外投资的规定》的适用对象为中国境内企业、其他组织和居民个人的对外（境外）投资活动；除法律、行政法规或国务院另有规定外，对香港、澳门、台湾地区的投资管理参照该规定执行，港澳台投资首次纳入参照适用范围。值得关注的是，该《对外投资的规定》除在管理机制、投资者义务及权益保护等方面建立健全相关内容外，也明确要求中国境内企业在境外其他国家（地区）投资的企业应建立健全合规经营安全生产制度，加强风险防范，如其中第16条规定：“投资者及其在其他国家（地区）投资的企业应当完善治理结构，建立健全合规经营、内部控制、安全生产、突发事件处置等制度，加强风险识别和防范处置，投入必要的人员、资金、设备等资源，保障其员工和资产安全”。此外，《对外投资的规定》第14条、第17条、第20条、第21条等若干条款也分别对中国境内企业的对外投资活动涉及的国有资产监管、出口管制、网络安全、境外投资矛盾纠纷解决方式等方面，明确规定了规范投资经营行为的合规路径及若干禁止行为类型。
