《德国刑法典》对公共部门和私营部门的贿 赂行为作出不同规定。
德国法律禁止向公职人员、从事特殊公务的 人员或联邦国防军士兵行贿，上述人员亦不 得收受贿赂。无论是否出于获取利益的目 的，向公职人员提供好处均是被禁止的。这 是为了杜绝公众认为向公职人员提供好处而 获利的不正确想法。下列情形构成严重贿赂 行为：（1）行为涉及巨大利益的；及（2） 行为人持续提供或收受利益，目的是不断实 施此等行为的。
