2022年8月4日，上海市高级人民法院发布了2021年度上海法院金融商事审判十大案例，同时首次发布了《2019-2021年上海法院涉资产管理纠纷案件审判情况通报》。典型案例和通报显示，近年来资管纠纷呈现两大特征：其一，2018年《关于规范金融机构资产管理业务的指导意见》（以下称“《资管新规》”）出台后，穿透式监管力度不断加强，打破刚性兑付、禁止通道类业务等具体监管措施陆续发布，资管产品违约频发；其二，资管业务交易结构复杂，疑难法律问题不断涌现，相关法律法规的理解和适用存在较大争议。《资管新规》及后续出台的系列金融监管文件对资管纠纷的裁判有着举足轻重的影响。本文将继续聚焦资管领域的代表性案件，学习和探究《资管新规》在近年来司法裁判实践中的应用。
